Welcome to PureVytals ("PureVytals," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of purevytals.com and any related services (collectively, the "Services"), operated from Agra, Uttar Pradesh, India. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

About Us

PureVytals is an Ayurvedic oral care brand based in India, offering products including MouthPure, a daily oral rinse formulated for tobacco users. PureVytals is powered by Shopify, which provides the underlying e-commerce platform.

Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order on the Services. By placing an order, you confirm that you meet this requirement.

Products and Health Disclaimer

MouthPure and any other products sold on the Services are Ayurvedic oral care products intended for general daily oral hygiene use. They are not intended to diagnose, treat, cure, or prevent any disease, and are not a substitute for professional medical, dental, or health advice. If you have a pre-existing medical or dental condition, are pregnant or nursing, or are taking other medication, please consult a qualified healthcare professional before use. Discontinue use and consult a doctor if irritation or an adverse reaction occurs. Product images, descriptions, and packaging are for illustrative purposes and may vary slightly from the product received.

Orders and Pricing

All prices on the Services are listed in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise. We reserve the right to change prices, product availability, and pack sizes at any time without prior notice. We reserve the right to refuse, cancel, or limit any order at our discretion, including in cases of suspected fraud, pricing errors, or stock unavailability. If we cancel an order after payment has been made, we will issue a full refund to your original payment method.

Payment

Payments are processed securely through Shopify Payments and/or our third-party payment partners. We do not store your full payment card details on our own servers. By providing payment information, you represent that you are authorized to use the payment method provided.

Shipping and Delivery

Shipping timelines, charges, and terms are set out in our Shipping Policy. We aim to dispatch and deliver orders within the timelines stated at checkout, but delays may occur due to factors outside our control, including courier delays or force major events.

Returns, Refunds, and Exchanges

Our return, refund, and exchange terms are set out in our Refund Policy. Please note that due to hygiene and safety reasons, opened or used oral care products may not be eligible for return or exchange, except where the product is defective or damaged on arrival.

Intellectual Property

All content on the Services, including but not limited to text, graphics, logos, product formulations, and the "PureVytals" and "MouthPure" names and marks, is the property of PureVytals or its licensors and is protected under applicable Indian intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.

User Conduct

You agree not to:

  • Use the Services for any unlawful purpose or in violation of these Terms;
  • Attempt to gain unauthorized access to our systems, other users' accounts, or any part of the Services;
  • Submit false, misleading, or fraudulent information, including during checkout;
  • Interfere with or disrupt the security or proper functioning of the Services.

Limitation of Liability

To the maximum extent permitted under applicable Indian law, PureVytals shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services or our products. Our total liability for any claim arising from your use of the Services or purchase of a product shall not exceed the amount you paid for the relevant order.

Indemnity

You agree to indemnify and hold PureVytals harmless from any claims, losses, or damages, including reasonable legal fees, arising from your misuse of the Services or violation of these Terms.

We will acknowledge and address grievances within a reasonable timeframe, and in any case within 30 days of receipt.

Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts at Agra, Uttar Pradesh, India.

We may update these Terms from time to time to reflect changes in our practices, products, or applicable law. Continued use of the Services after any changes constitutes your acceptance of the revised Terms.
